The airline that owned a plane that crashed while trying to take off on the wrong Kentucky runway is suing the government, officials said Thursday.

Comair is accusing the Federal Aviation Administration of negligence, saying there should have been more than one air traffic controller on duty. Only one was in the control tower; records show he was doing administrative chores when the crash occurred.

49 of the 50 people aboard died when the plane crashed last August in Lexington. In the dark, the crew mistakenly turned onto a runway that was too short.

Comair has tried suing the FAA over the crash before, accusing the agency of not inspecting and approving construction along the taxi route. That case was dismissed on Tuesday.
