Two New York City men won't face charges for wheeling a dead friend to a store to cash his Social Security check.

They said they didn't know he was dead when they left for the store, and prosecutors can't say exactly when he died.

The men said they were distraught over the loss of their longtime friend.

The story generated several references to the movie "Weekend at Bernie's" when it made news in January.

David J. Dalaia and James O'Hare had been charged with forgery, criminal possession of a forged instrument, attempted larceny and improper disposal of a body. Charges were dismissed Tuesday.

They had pushed Virgilio Cintron's body from the Manhattan apartment that O'Hare and Cintron shared to Pay-O-Matic, about a block away, a police spokesman said in January.

The men left Cintron's body outside the store, went inside and tried to cash his $355 check, the spokesman said. A police detective saw a crowd forming and intervened.

Cintron's body was taken to a hospital morgue. The medical examiner's office told police it appeared Cintron, 66, had died of natural causes within the previous 24 hours, the spokesman said.
