Judge considers dismissing Dole banana suit

A court hearing is being held in Los Angeles to determine whether to dismiss a $2.3 million verdict in a lawsuit against Dole Foods that claimed Nicaraguan banana workers were sterilized by exposure to pesticides.

Dole lawyers claimed Monday that an American and a Nicaraguan lawyer recruited men to make false claims in order to win the verdict several years ago.

In court, Dole played videos of an attorney asking people to join what he called a war against Dole.

The case is being heard by Victoria Chaney, a former Superior Court judge who is now with the state appellate court. She presided over the original case being heard Monday and a related case that she dismissed last year on grounds of massive fraud.
