A Philadelphia jury is to consider whether a man convicted of first-degree murder for killing a policeman deserves the death penalty.Twenty-three-year-old John Lewis pleaded guilty last week to a general charge of murder for killing Officer Chuck Cassidy when the policeman walked in on a doughnut shop robbery. The jury decided Thursday that Lewis intended to kill Cassidy when he fired the gun, making it first-degree murder. The defense had tried to argue that Lewis was panicking and didn't have that intent, making it second-degree murder and eliminating the possibility of the death penalty.The trial now enters the penalty phase, in which the jury hears more evidence about aggravating and mitigating circumstances. If Lewis doesn't get the death penalty, there's an automatic sentence of life without parole.
