A man is facing an assault charge for allegedly hitting a town hall custodian on the back of the head with a roll of toilet paper because he was angry the cleaning man was whistling while he worked.

Framingham police said 55-year-old Allen Kerner was in the town hall Wednesday using the bathroom, The MetroWest Daily News reported.

Meanwhile, the custodian, not realizing anyone was in the restroom, began to whistle as he replenished toilet paper rolls.

He told police he was in a stall when he was struck on the back of the head by a roll of toilet paper.

"He turned around, and (Kerner) began yelling at him about whistling and then he fled the bathroom," police spokesman Lt. Ron Brandolini told the Daily News.

The custodian pursued him and Kerner was apprehended by police outside, who were alerted to the chase because Kerner was screaming, the Daily News reported.

Police told paper that Kerner would be summoned to court to face an assault and battery charge.

Brandolini told the Daily News that Kerner felt the whistling was directed at him.

"(Kerner) said he was angry about being whistled at," he said.
