An Oregon woman accused of murder in the death of her 2-year-old appeared to wink at a judge during a hearing in her criminal case. Jessica Smith was in court for the second time in two weeks for a brief hearing on charges of aggravated murder and attempted aggravated murder, according to NBC News affiliate KGW in Portland. Smith appearing before the court via video link from jail, appeared to wink when answering one of the judge’s questions.

Smith is accused of drowning her 2-year-old daughter in a hotel bathtub and slashing her 13-year-old daughter’s throat and wrists. The older daughter survived the incident and is currently staying with family members under the legal custody of Washington Protective Services. Smith will remain in jail without bail as her attorney seeks a mental health evaluation for his client.
